1. Welcome
Welcome to bod Pilates. By booking a class or purchasing a membership or class pack, you agree to be bound by these Terms and Conditions.
We reserve the right to update these Terms and Conditions at any time. Changes will be published on our website, and your continued participation in classes constitutes acceptance of any updated terms.
References to "we", "us", and "our" refer to bod Pilates Pty Ltd.
2. Medical Warning
Before beginning any new exercise program, we strongly recommend you consult your doctor or healthcare practitioner.
During class, work at your own pace. Stop immediately if you experience pain or discomfort, and seek medical attention if you notice any unexpected changes to your physical condition.
You must inform your instructor before class of any pre-existing injuries, medical conditions, or pregnancy.
By participating in our classes, you acknowledge that you do so at your own risk. bod Pilates Pty Ltd, its instructors and staff are not liable for any personal injury, loss or damage arising from your participation in classes or from following advice given by instructors or published on our website.
3. Pregnancy
Our regular classes are considered safe to attend up to 14 weeks of pregnancy. Beyond 14 weeks, medical clearance is required before continuing. Participation past 14 weeks is at your own risk.
4. Booking and Attendance
All class spots must be reserved in advance via the bod app or Mindbody platform.
We recommend arriving at least 5 minutes before your class. For safety reasons, late arrivals may be unable to join the session and will be recorded as a no-show.
Reformers may be released to waitlisted clients if you have not arrived by the time class commences.
Clients are discouraged from leaving class before it concludes, as this is disruptive to other participants.
5. Cancellation and No-Show Policy
bod operates a strict 10-hour cancellation window for all classes.
Any cancellation made within 10 hours of the scheduled class start time, or any failure to attend a booked class, is considered a Late Cancel or No-Show and will incur the penalties outlined in Section 6.
How to cancel: Cancellations must be made via the bod app or Mindbody platform. Cancellations sent via text message or social media to instructors are not valid and will not be processed.
In the event of an emergency, please still cancel via the app or platform and email info@bodpilates.com so our team can best support you.
Waitlist bookings: Once confirmed into a class from the waitlist, the 10-hour cancellation window applies. Please remove yourself from the waitlist if you are no longer available to attend.
6. Late Cancel and No-Show Penalties
Penalties are applied automatically based on your account type.
Unlimited Memberships A fee of $15.00 will be automatically charged to your stored payment method for every Late Cancel or No-Show.
4 or 6 Class Fortnightly Memberships The missed class will be forfeited for that fortnight. It cannot be carried forward. If you wish to attend an additional class to replace the forfeited session, a discounted rate of $25 per class applies (standard casual rate: $35).
Class Packs One (1) class will be automatically deducted from your remaining pack balance.
7. Membership Conditions
Minimum term: All memberships carry a minimum commitment of 6 months from the date of sign-up.
Auto-renewal: At the end of your initial 6-month term, your membership will automatically renew for a further 6-month period under the same terms, unless cancelled in writing prior to renewal.
Cancellation of membership: To cancel before your membership renews, written notice must be submitted to info@bodpilates.com at least 14 days prior to your next renewal date.
Price protection: Your membership price is locked for the duration of each 6-month contract term. If a price increase is introduced, it will take effect at the start of your next 6-month renewal period, with a minimum of 14 days' written notice provided beforehand.
Class allocation (fortnightly memberships): Classes are allocated per two-week cycle. Unused classes do not roll over to the next cycle.
Failed payments: It is your responsibility to ensure sufficient funds are available on your nominated payment method. If a direct debit is declined, our payment provider may charge a failed transaction fee, which will be passed on to you. bod reserves the right to charge a late fee where payments are overdue.
8. Class Packs
All classes must be pre-paid prior to attendance.
Class packs are non-transferable and may not be shared, gifted, sold or transferred to any other person.
Expiry dates:
10-class pack: valid for 3 months from purchase
20-class pack: valid for 6 months from purchase
50-class pack: valid for 12 months from purchase
Unused classes that expire are forfeited. bod Pilates does not offer refunds, transfers, suspensions or extensions on class packs for any reason, including illness, injury, change of mind, change of address or user error.
9. Membership Holds (Suspensions)
You may place your membership on hold for a minimum of 2 weeks and a maximum of 4 weeks per request.
Written notice via email to info@bodpilates.com is required at least 7 days in advance. Membership perks are paused for the duration of the hold. Hold periods do not count toward your 6-month contract term.
10. Studio Policies
Grip socks: Grip socks are mandatory for all sessions. Regular socks are not sufficient.
Mobile phones and smart watches: Please switch off mobile phones and smart watches before class begins.
Children: For the safety and focus of all members, children are not permitted in the studio during class times.
Conduct: bod Pilates reserves the right to refuse entry to, or remove, any client behaving in an anti-social, aggressive, intoxicated, disorderly or dangerous manner.
Smoking: Smoking is prohibited inside and outside the studio at all times.
Personal belongings: bod Pilates is not responsible for the loss or theft of personal items brought into the studio.
Response times: For all account queries, please email info@bodpilates.com. Please allow up to 48 hours for a response.
11. Tactile Cueing
Our instructors use tactile cueing and hands-on adjustments as part of standard Pilates instruction to support correct form and safe practice. By participating in classes, you consent to this form of instruction.
12. Limitation of Liability
To the extent permitted by law, bod Pilates Pty Ltd excludes all liability for personal injury, loss or damage of any kind arising from your attendance at our studio or participation in our classes.
Our liability in relation to recreational services (as defined in section 139A of the Competition and Consumer Act 2010 (Cth)) for death or physical or mental injury is excluded, except in cases of significant personal injury caused by our reckless conduct.
13. Privacy
Your personal information is collected and handled in accordance with applicable privacy legislation. By signing up, you agree to receive studio communications via email and SMS. You may opt out of marketing communications at any time.
14. Jurisdiction
These Terms and Conditions are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for any matter arising under these Terms and Conditions.
